EEA national forced to prove right of work beyond Oct 31st

Hello

I am talking to an EEA national who is being pressured by his employer to go through the EU Settlement Scheme immediately.

He showed them his Spanish passport. They made a copy of it but they told him that his EEA passport proves his right to work in the UK until October 31st 2019.

Despite him living in the UK for years, he would be entitled to "Settled Status", he is not keen to do it at hte moment as he claimed his passport should be more than enough even beyond October 31st regardless of the Brexit conditions.

It seems to me like the HR people are not aware about how things work. But it's hard to argue against them! I think more and more people will be in this situation.

Almost the same happened to my husband (Dutch) just a few days ago. Well, he wasn't forced (he actually already has Pre-settled) but he was asked by HR to bring "something" before 31st of Oct.

This guy didn't apply for the EU Settlement scheme but they want to see something before the end of the month.

November 1st, they are no longer going to accept his EEA passport as proof of right to work in the UK.

It seems the Brexit will be even harder with HR departments!

Employer is doing their job to obey their obligations in relation of checking and keep updated their employee's right of work. UK govt is still generous who is giving plentyful time to EU citizens to avail that opportunity and if they are not interested then only they are on fault. Also same in private tenancy has also been happening.
