Can my kids be registered as British citizen if I become British citizen?

Post by Mazbridge129 » Wed Oct 09, 2019 5:51 pm

Hi everyone,

I have indefinite leave to remain, I have 3 children in total , the first two children were born abroad and my last child born in the UK last year,
My wife and my other two children they are on settlement visa due to renew next year June 2020, I have applied for naturalization for my self since November 2018 and not heard anything yet, my solicitor filed a complaint to the home office and we still waiting I don't have any issues in the UK size I came to the country,
My questions are is it normally taking this time for a citizenship application to be approved??
I want to know can i apply for my kids to be citizens after I have my passport?
I just don't want to go throw all the visa process again for all of them specially the financial requirements as I'm earning less than 24k and that will affect the visa process that my worry,

Thank you

Was your UK born child born before or after you got ilr??

Presumably after ilr. If that is the case, then the child is automatically British and can apply for a passport directly.

The two children born abroad will follow the same path as your spouse and need ilr before they can apply. Your spouse also need ilr first for them to qualify. You becoming British doesn't retrospectively make them British or entitled to citizenship.

Is the renew of the visa will still have to be 24k?

Will have to be 3 months payslips or 6 months ?

Post by Mazbridge129 » Mon Dec 09, 2019 8:11 am

Hi everyone,

May wife and two kids are on 5 years settlement route visa,
Finishing their first 2.5 years in 6 months, I become self employed last April this year my finaical situation has been change since,
I can't afford the £24800 limit for extension which is going to cost me over £7k paying the hmrc tax and home office applications ,

Just wondering anyone went throw that and any advice of what will happen or what should I do will much appreciated?

What should I do please, and even if she got refused what's going to happen? Will 10 years route will be my option, that means I will have to pay the same amount of money every 2.5 years??

Just wondering anyone went throw that and any advice of what will happen or what should I do will much appreciated?

Thanks

The 10 year route may be an option if you are unable to meet the financial requirements provided you are able to make a good case that there are "exceptional circumstances" that would apply or that a refusal could/would result in "unjustifiably harsh consequences" for your family (being settled and having a British child will likely help in this regard). Have a read of the guidance document linked below.

The fees are the same as far as I know. Below is the guidance on eligibility for having the application fees waived but it does not seem like a fee waiver being granted is very common. Any chance your wife has some employment income you could add to help satisfy the financial requirement?

I'm just a guy on the Internet who immigrated to the UK. My opinions are based on my experience and interpretation of the immigration rules and should not be considered legal or immigration advice; your mileage may vary.

A fee waiver for FLR(FP) is usually only granted if the applicant is destitute/homeless and has no income means etc.
