Standard UKVisitor Visa Extension

Hi Guys,

I need some help in understanding the duration for a standard visitor visa. I know that the maximum duration some one can stay is 6 months. However, I have a specific query relating to my mother’s travel.

My mother arrived in UK on May 1, 2019 and went back to India on 22 Aug, 2019. The total stay for the whole period was 3 months and 22 days even though the visa was granted for 6 months. The visa is now expired.

We are planning to call her again on a new visa in Jan 2020 which is within 6 months of her exit from the last visa.

Could some one let us know how the duration is calculated, should she be able to stay for another 6 months with her new visa or she can only stay the remaining period from her last visa to complete the 6 months.

The general guidance is that a visitor shouldn't be spending more time in the UK than they are spending in their own country in a 12 month rolling period.

In addition to casa's advice, how long did she state in her last visa application that she would be visiting/staying in the UK?

When you say 12 month rolling period, can you advice what do you mean? Is it calculated from the last entry to UK? Is there any restrictions for 180 days or it can be more?

For my mother’s last visit, we stick to the dates as we had return tickets. We mentioned 3 months and 22 days to the immigration officer and returned accordingly.

Entry to UK - 1 May, 2019
Exit from UK - 22 Aug 2019

In the last application there are 2 questions -
1. Date of planned arrival in UK - 18 Apr 2019
2. How long do you intend to stay in UK - 6 months

But we had return tickets so we planned for 3 months and 22 days.

The 12 month rolling period started with your Mother's entry to the UK on her last visit.

Do you mean she can't stay more than 6 months in this 12 month rolling period?
If it correct, before 1 May 2020 (as last entry with previous visa was 1 May 2019), she can only complete the remaining number of days only and has to return back?

Am I correct in understanding. Please advice.

If you mother spends more than 6 months in the UK between 1st May 2019 and 31st April 2019, it may be considered that she is 'residing' rather than 'visiting'. This could then have an adverse affect on a visitor visa application in the future.
