Tier 2 Dependant Extension where main applicant is still on Tier 2 General

Hi All,

I really need your assistance with this issue. I hold a PBS Dependant Visa which is due to expire on September 14. The main applicant, my spouse, switched jobs and has a new Tier 2 visa for three years. She was not required to provide evidence of maintenance of funds when she applied. Upon filling my application form for extension of my visa, I noticed that I was required to show evidence of holding 1,260 pounds for 90 days (for me and my son). I do not have these funds although my spouse can provide this.

Should I cite Paragraph 83 of the SWS Dependant Policy Guidelines in a covering letter as part of my supporting documents or provide my spouse's bank statements showing these funds? Please advise.

Either spouse can prove maintenance funds. There is no requirement that it must be the applicant only.

Thanks for your advice. The extension approval was obtained recently. It came in a delivered letter to my UK address. I was expecting an e-mail but got a letter instead. The BRPs came in 5 days after the notification letter.
