Tier 4 dependent to Tier 2 general (main applicatnt)

Hi,
Need a quick advice.

I'm currently on tier 4 Dependent visa valid till Feb next year. My wife is doing here Masters. I've been offered a job which falls in shortage occupation list and my employer is ready to sponsor me. For my application my employer hired a immigration solicitor. After taking my current visa details the solicitor replied as below...

can apply after his wife can show that she has successfully completed her studies in the UK. This way he does not have to leave the UK in order to submit his application. If he is to consider this option, he must ensure that his wife will obtain her results prior to the expiry of their visas.

Is this required. I've gone through all rules of tier 2 switch. no where it states that I've to wait for my wife result in order to apply Tier 2 main applicant for myself.

You have nothing to do with your wife's masters. You can apply anytime within UK, you need Restricted COS(Tier 4 Dependent to Tier 2 General).

Solicitor seems like no idea about immigration policies.
