ILR- Long Residence Route

Hi All,

Firstly I'd like to thank the moderators and all the people who help in answering questions, I have heard great things about this website. I am in the process of submitting my ILR- Long residence application and have the following questions.

1. I have been on Tier 4 visa for 3 years and then PSW for 2 years and Tier 2 General for 3 years then again switch into Tier 4 general for 2 years- So in total 10 years- am I eligible to apply for ILR- Under Long residence?

2. As mentioned earlier I am currently on a tier 4 visa which is due to expire in Feb 2020 and I will complete my 10 years on 29 September 2019- So can I submit my application online by 2nd of September 2019 taking into account 28 days prior to qualifying period criteria. If yes, then one of the questions on the application form is how long you've lived in the UK for? Am I ok to assume to put 10 years when applying on 2nd September 2019 although the actual 10 years would be on 29th September 2019?

3. I've married a UAE national and currently, she is in UAE doing her masters, although we don't live together in the UK due to work and studies commitment, however, we try and see each other every couple of months. now the question I have is - while filling application one of the questions was "Do you and your partner currently live together?" I answered "No" and then following up question was "Why do you not live with your partner?" So I explained that's she is currently studying etc and we see each other when possible".

Now, UKVI is asking for following documents -(Evidence you have to prove the relationship
with wife (for example marriage certificates)- and correspondence addressed either to you jointly, or in both of your names, or addressed individually to you at the same address, to cover the last two years)

So I can provide marriage certificate however I cannot any correspondence as my wife is not living in the UK- so I am a bit confused whether they are asking for documents from UAE or UK- any suggestion on this would be greatly appreciated.

4.Document(s) showing the immigration status of my wife's such as a passport, biometric residence card, or vignette- Again as she is not a UK resident, I wouldn't have any of those documents- although I can submit copy of UAE passport- will that be sufficient?

Presumably, as you don't state any of the exact dates, all your applications were in time and approved and no invalid, rejected or refused applications. So yes, if you have 10 years legal residence and meet all the standard LR requirements, then you can apply.

If 2nd September is 'within 28 days before meeting the residence requirement' then yes.

None of this is relevant to the supporting documents for Long Residence ILR.

Thank you so much. However when I filled in my ilr application and at the end point 3 and 4 are the list of documents they are asking.

My Life in the UK Test pass notification.

Fifth Item on List of Documents

My passport

Sixth Item on List of Documents

My BRP

Seventh Item on List of Documents

All previous passports, travel documents or national identity cards that you have used to
travel to or remain in the UK


On a separate note, one of the questions was as below

Do you have any other reasons for wanting to stay in the UK? (Required)
For example, include any information you wish to be considered about the welfare or best interests of any children who will be affected by the decision or medical evidence such as evidence of serious ill-health.

So I selected the option – I do have any other reasons for wanting to stay in the UK.

Again, I am so sorry as you can understand this phase is crucial and I am trying to make sure everything is in order.

Also to answer your questions in regards to any invalid or refusals- I had none- everything was straight through as almost all of my applications were on same day service.

Hi Again,

I have a follow up question.

One of the question on Set ( LR) application is- how long have you lived in the UK for years/months.

Now my question is - Date of arrival in the UK was 29 September 2009 and I think my 10 years would complete on 29 September 2019 however taking into account I’m applying 28 days earlier to either 2 or3rd of September 2019. So when it come to answering the above questions in terms of numbers of years/months in the UK. Am I suppose to answer 10 Years O months ( or) 9 Years 11 Months.

My understanding is that the applicant mentions they were in UK for 10 years even if the application is set out to be made 28 days before the 10th anniversary.

The case workers are instructed to allow this early application providing it is only within the 28 days.

Do you think it will be useful if I mention this in covering letter, I just don’t want to give any reason for them to refuse, you know how silly they can get information we provide. I just don’t want them to think I’ve provided incorrect information by filling in 10 years when it’s 9 years 11 months and 5 days.

However I’ve add 2 different responses and It’s making me worried. Like I said I just don’t want to me in a situation regretting .

Any further suggestions guys? Or any one who’s applied ILR - Long Residence 28 days or Less earlier.

This question is not important enough to impact ur application..
I applied via the 5 year route. I had been her for only 4 years and 10 months and that’s exactly what I stated.
It’s usually better to be precise. HO will easily calculate the time you’ve been here by ur entry date.
Find something more important to overthink!

9 years & 11 months and if there is another option of day too then 9 years 11 months & 2 days.
