Spouse Visa

Good Morning. I am Rhodesian born, on a British passport. My husband is South African. Our children are emigrating to Ireland and Canada and we are wanting to relocate to the UK to be closer to them. I've been trying to make sense of the spouse visa rules and come away very confused. Please could someone simplify them for me. Many thanks.

A rather broad request, might be better off asking questions about the parts you're having confusion with. I'll give it a go though. You will have to prove a genuine and subsisting relationship, generally through either evidence of living together or ongoing correspondence. You will have to prove your husband meets the English language requirement, generally either through a educational background in english or passing an english language test. Your husband will have to prove that he has suitable accommodation available when he arrives in the UK. You will have to prove that you meet the financial requirement either through an annual income exceeding £18,600/year or cash savings exceeding £62,500 held for a minimum of at least 6 months, or a combination of the two (proceeds from sale of property can also be used). With regards to income, only that of the British citizen is considered for the first application, your husband's income cannot be used but any of his savings can. If you are using income, you will have to prove that your current income exceeds the financial requirement and that you have confirmed employment in the UK that also meets the financial requirement and will start within 3 months of arriving.
