Tier 1 entrepreneur dependent and SET(LR)

My husband applied tier 1 entrepreneur set o application and i applied as a dependent on 20 September 2019 and we gave biomatric on 22 October 2019. Now my husband vary application as set lr. Today I received email from home office that main applicant changed the application they asked me do you also want to vary your application. I will also vary the application but i am confused which application should i vary. Can you plz help me

You have to vary to FLR(M) spouse visa.

You need to meet the A1 English test requirement and the £18,600pa financial requirement.

Your clock for ILR based on 5 years residence will reset to zero and you will need 2 x 2.5 year visas.

Yes. You do not qualify to stay as a Tier 1 Dependent or get ILR as a Tier 1 Dependent if your husband varied to ILR based on long residence.

You must vary your application too and meet all the requirements otherwise your Tier 1 dependent application will be refused.

When i started to fill FLR M application from starts its ask me that your partner settled or British passport holder. The question is my husband set lr application still on process so still i have to use this flr m application

Yes, there is no route to ILR for you via the Tier 1 dependent visa or extending your Tier 1 dependent visa if your husband has applied for ILR based on 10 years long residence.

These rules have been in place since April 2014, so it is not a new rule at all. You have to switch visa routes, which resets your 5 year clock for ILR to zero.

You could say settled and explain in the form. The form also asks you if you have an application pending with HO. I cannot see the online forms so don't know what they ask.
