Cooling off period clarification

Post by Mpreshit » Fri Nov 01, 2019 6:03 pm

Hi,

I have switched from tier 2 ICT to Tier2 ICT dependent on 15th nov-2018.
I am Still in the UK and working for an employer.

As my employer is ready to sponsor tier-2 general visa for me, I was told that i need to finish off the cooling off period of one year before I apply again for tier-2 general visa from Outside the Uk(India).

I have below questions:

1) Is cooling off applicable to me as I was on PBS dependent?
2) If cooling off is applicable on what date can I start filing application in the system and on what date can I go for visa appointment?
3) When I read ‘ you can apply after cooling-off’, does it mean that I can submit the application in the system on any date before cooling off but the visa appointment and document submission has to be after cooling off date?

Any responses would be highly appreciated.

Regards
Preshit

1. Yes it still applies. You need to have Held a dependent visa for 23 months. You can only apply for a tier 2 after 15th November 2019, from home country.

2. 16 November 2019. When you can go for an appointment depends on when you go back to home country.

3. Apply after the 12 months is complete.

Note you also need a restricted CoS, which is only done once a month at the RCoS allocation meeting. Only once that is approved can you apply from home country.
