FLR (M) question non applying children?

Post by carlslewood » Thu Nov 14, 2019 4:04 pm

Hi All

I was wondering if someone can help me with the online FLR (M) form question "Non Applying Children" ? I would think this means any children that are not applying on my wifes visa ?

To explain, I have in the past helped my wife successfully completed several visa applications, visitor visa, spouse visa to come live in the UK with me after our Thai marriage, with no problems, however we are now trying to complete the second part of her 5 year visa, FLR (M), but have come up against a brick wall with the online form.

It asks the questions,

For example, 2 years and 6 months

Of course I can't complete this as he has never been to the UK

Sorry this is so long but thought it best to show how the form progresses.

My wife has a 9 year old son who lives with her parents in Thailand and we have no intention of bringing him to the UK.

If we click on NO instead of YES to the question,

Non Applying Children Do you have any children of 18 years old or under?

it then does not ask anything further about children and goes straight to asking about me.

Am I misunderstanding the meaning of "Non Applying Children" ? should we click NO to the question ? and if so why?

Many thanks for any help with this.

Hi carlslewood, did you manage to resolve this ? we are in a similar situation, my wife has 3 children living with their father in the Philippines, they do not live here with us so they are not applying with my wife but we are being asked for all their details and their date of entry to the UK.
Thought I would see what happens if we ticked no children under 18, it then asked for my details, my ex wife's details including proof of her address and all of my 3 children's details inluding their passport information.
I just can't understand the relevance of all this.
Obviously if we do procede with ticking no children under 18 we are contradicting the original visa application and a risk of refusal.
I really am stuck as to what to do and would be greatful for any help from someone.

Hi

I had the same problem with the FLR(M) application form. This is what I wrote and our application was successful at first pass:

Note about X’s daughter – Y

X has an 8 year old daughter, Y, and I had the pleasure of meeting her during my visit in November 2018 and during my recent holiday. X and I discussed the possibility of applying to bring Y to the UK also, but we decided not to do that at this time. We found this part of the online application process a bit confusing as we do not intend for Y to come to the UK at this time. She will continue to live in the Philippines. There was a question on the online application about ‘non-applying children’. But when we answered the question – ‘are all your children applying with you on this application’? We tried to answer ‘No’, because we are not intending for Y to come here at this time. But the system generates a whole series of questions that don’t seem to apply to us? It asked what date the child came to the UK, which we could not bypass without entering a date. We didn’t want to enter a date because she has never been to the UK. So as we didn’t want to give false or misleading information, we entered ‘yes’, and decided to explain by way of this covering letter. I have searched the internet widely in order to try and see what we should have done in the online application, but only found queries from other people in the same situation asking the same question on immigration boards. I even paid £60 to see an immigration solicitor yesterday but he couldn’t help me either. We answered as honestly and as best we could and hopefully this cover letter will clarify everything. I gave feedback to the UKVI regarding this by taking the online survey and have volunteered to take part in consumer testing in future.
