Cash gift deceleration - how detailed

Post by Neemo » Sun Nov 24, 2019 8:12 am

Hi everyone,
This is my first post here....

My question is about declaring cash savings for Uk spousal visas. I have held more than the required amount (about 70k) in mine and my sponsor (wife’s) joint account for the last 1.5yrs and it was previously in my own name in the Uk for several years prior. I can show a gift of 53,000 pounds leaving my parents account and going into mine back in 2014, but the rest of the money is made up from money my parents had given me when I was studying in the UK more than 20 yrs ago. I don’t have a clear record of this.
Would it suffice to get a declaration from my mother showing the transfer for the bulk of the money (53,000 pounds) as well her her statements showing I haven’t compromised her financial position) and for the rest of the money simply getting her to state it was a gift for my own maintenance which she doesn’t need re-payed? I have been worried because I can’t show the full amount as a gift, only part. I was hoping that because the money has been in my name for several years it wouldn’t be an issue as it is not a loan. Any advice would be hugely appreciated from this excellent forum.

Thanks! Neemo

Maybe your own declaration declaring the source of these cash savings might be enough.
7.5. Cash savings – specified evidence
7.5.1. The evidence required for cash savings is specified in Appendix FM-SE:
11. In respect of cash savings the following must be provided:
(a) Personal bank statements showing that at least the level of cash savings relied upon
in the application has been held in an account(s) in the names of the person and
their partner jointly throughout the period of 6 months prior to the date of application.
(b) A declaration by the account holder(s) of the source(s) of the cash savings.

The opinion expressed as above is neither a professional advice nor contesting/competing to other member's opinion/advice.

Your mother can write a declaration saying that she gave you a gift. My father wrote me one as he transferred £15,000 into my account a few years ago. This was from an investment he made in my name. My father stated it was a gift.
You can give your mothers bank statement as well to show the transfer. You can also go to your bank and ask if its possible to print statements from 20 years ago. You would have to get them stamped by you bank.

Thank you For the replies. My mother is the principal account holder from the account she has gifted me from, but my brother is also a signatory to the account. My mothers name shows in my statement when she paid me the gift. However, My brothers name also appears on a sub-line on my mothers statement. Do I need to also get my brother to sign the decleration ? Thanks

I think you should. Do not give them any reason to refuse the application.
