Hello Guy

I have a question with regards to the fiancé visa if one of you could please help?

My girlfriend is Peruvian / Venezuelan and has been living in Mexico for the last year on a temporary resident visa. She came to stay with me In the UK for 4 months, where I proposed and we are going to hopefully if all goes well get married next June 2020.

She has now since returned and her Mexican residence visa has just expired, and has 55 days to renew it, which can take up to 6 months to receive. We are currently in the process of doing our fiancé visa application and one question asks for evidence of permission to be in the country you are applying from. If we put in the notes our current situation and send a copy of the expired residence visa, do you think they would accept this, or do you think it will be rejected due to the fact it’s just expired?

Any document or evidence provided or submitted should be valid and authentic at the time of application. I doubt if sending a copy of expired visa and explaining will be of much help.
Is she renewing it already?

That’s where we don’t know what to do and need the advise, because we are hoping to do the fiancé visa and have it accepted so will not need to renew the resident visa. If she starts the process to renew we won’t have a valid residence card in time for when her appointment for the biometrics is anyway, as they say it takes 3 months to receive, but her lawyer has already said it’s “meant” to take 3 months but usually is closer to 6. So kind of really stuck as how to proceed?

If she doesn’t plan to extend her Mexican residency, is it an option to go back to her own country and apply there?

Otherwise you will indeed get stuck first with Mexican and then with British HO. Even if the expiring permit (but still valid at the moment of application) will satisfy British HO, you don’t want an overstayer status in her immigration history in Mexico
