Tier 2 Dependent Visa Extension after ILR of main applicant

Post by naampadobi » Wed Sep 25, 2019 11:26 am

My tier 2 dependent visa is due to expire at the same time as my husband's. My husband is applying for ILR but I've been here for 3 years. So, as I understand from the other posts that I have to apply for Tier 2 general dependent's extension so that I can complete five years in this category.

1. Wondering what supporting documents are required to furnish with the Tier 2 general dependent's extension application?

2. Regarding cohabitation, could we combine proofs with joint names and individual names? (For example, for different time of the timeline we have joint bank account statement, Joint House agreement, individual bank account statements, individual NHS Letters, individual Voter registration letters from Council, individual HMRC Letters)

Thank you!

1. The online form will tell you. Passport, brp, maintenance funds for 90 days, cohabitation.

2. Yes.

Tier 2 Extention, Husband got ILR but awaiting BRP

Post by naampadobi » Fri Nov 22, 2019 2:35 pm

Hi there,

I joined my husband as Tier 2 General Dependent 3 years ago. He has completed his 5years on Tier 2 General and got his ILR approved but still awaiting for the BRP to be delivered.

I am now applying for Extention of my Tier 2 General Dependent for another 3 years so that I could complete 5 years before I could apply for ILR.

While completing the form (https://visas-immigration.service.gov.uk/product/pbs-dependant-partner) there is a question about the main applicant (husband)
1. "Which visa or permission to stay has Mr Name Surname applied for or been granted?" There is no option for ILR and the nearest option is "Tier 2 (General)". Is it OK to select that?

2. "Do you have one of these Home Office reference numbers for Mr Name Surname?" Could I select here "Yes, I have their entry clearance number" and use his approval email reference number?

3. As the biometrics appointment will be further down the line, by then we expect to have the ILR BRP for my husband. Could we change these details during the appointment?

Thank you in advance for your kind help!

1. Yes

2. Not sure. I suppose either.

3. You cannot change the application at any time once submitted online.

When does your visa expire?

I would suggest waiting a couple of weeks till the BRP is delivered before applying and submitting online.

BRPs take 7-10 days to be delivered by DX Courier.

When being redirected to the IHS form, there are questions regarding the date the Husband's visa is valid upto. Given he has his ILR, if we put that ILR valid upto date it is calculating the IHS for five years. I would like to apply for 2.5 years of extension. Should I put my husband's visa end date 2.5years from today?

You can't apply for a 2.5 year extension. A PBS dependent extension is for 3 years when the main PBS migrant has ilr. The 3 years is dictated by the immigration rules and there is no discretion for a lesser time to be granted.

Put ilr expiry date as X November 2022, 3 years from now to get the correct amount of £1200.
