Family visa application

Post by FarazJoni » Tue Nov 26, 2019 11:52 pm

Hello,
i have a question regarding for my family visa,i am on indefinite leave to remain visa, i am a director of my own company i have 2/3 question if anyone can help me out as i already done all documents just waiting for these and i am confused,
Note: my solicitor is saying i have to pay both taxes before i have to apply family visa and in the certificate (C203 or whatever) will not show the balance tax to pay( Income or either Corporation both) is that true??

Question 1....As a director i showed in my yearly accounts 2018/2019 (6,000 yearly salary, Dividend income 16,200 ) and the net profit 20,000 will this cover my yearly income for my family visa??

Question 2...The main question is my accountant said i can pay income tax 626 pounds now and the corporation tax that is 3364.25 i will have to pay until the time is due that is april 2020, will this acceptable in Home office for family visa application?? because if not i have to pay more or less 4000 pounds only for tax. and will the HMRC give me the certificate (C203 or something )that i paid the tax??and that will acceptable in home office with out paying the corporation tax??

please give me some information regarding my family visa application i will be very grateful to you if anyone can help me out thanks.

This sounds more like you need advice on accounting and taxes more than anything else. Here is the guidance on the financial requirement for the spouse visa:
https://assets.publishing.service.gov.u ... -ext_1.pdf

Pages 67 and 68 list the specified evidence required to be submitted in support of income as a director. If you are able to provide the evidence listed for the full financial year being relied upon, then you should be fine. As you already have an accountant and a solicitor, their advice may be best to follow to ensure both tax and immigration requirements are met.

I don't know for sure. I'm not sure why the Home Office would care whether corporation tax were paid prior to a visa application if it's not due until April, but I am neither an accountant nor a solicitor. If you can provide all of the specified evidence without paying the corporation tax first, then I can't see why you would have any issues. You definitely have to provide evidence of having filed a Company Tax Return (CT600), there is nothing in the guidance about having to provide proof of having paid corporation tax as far as I can tell.
