See the guidance linked below for this type of application, which should help answer questions 2 and 3. Looks like you could apply using the FLR(FP) form if you feel that is the closest match to your circumstances. An FLR(FP) application should also be assessed by the Home Office to whether a refusal would be a breach of ECHR Article 8. The guidance states that "if an applicant in the UK wishes to be considered solely outside the Immigration Rules, they should apply using the FLR(HRO) application form or FLR(IR) form. Applicants should indicate that they are applying for other purposes not covered by other application forms".
