fiance visit visa to get married refused

fiance visit visa to get married refused

I have been in a relationship with my partner for 12 years. We want to get married in UK I'm British Citizen he is Egyptian. He is a widow with a daughter. His daughter is 18 and has a job and will not be coming with him. His application for a visa has been refused because according to the home office he didn't demonstrate his economic and social ties to his country to indicate he will return after a short visit. He doesn't have a bank account all his business (he has a shop) buying and selling is done using cash. He supplied the shop lease tax card and business registration certificate, (They said in isolation these documents don't demonstrate the business is trading.) flat rental agreement & property ownership,also, proof that we'd booked the registry office for the ceremony, I supplied a sponsor letter detailing I am willing to support him during his stay and he will live with me for the duration.

What do we do to satisfy the home office that we will adhere to the conditions of the visa.

Did you apply for fiancee visa or for marriage visa?

Did you apply for a marriage visit visa (which requires the applicant to leave the UK after the marriage) or a fiance visa (which, after the marriage, leads to a spouse visa and eventually settlement)?

I suspect that it was the former, in which case what proof did you attach to show that he (and possibly you, as you'd be just married) will leave the UK after the wedding?

He provided evidence of his business and property, also, he has his daughter, but unfortunately didn't submit evidence of her birth certificate. He will return to his work. I won't be returning with him to Egypt, I will stay here and continue my work. Then in a couple of years the plan is for me to retire and move over there.

I think this is going to be hard (or near to impossible) to convince HO that your husband will leave the country.

Does he have a well paid job in Egypt? Would you otherwise qualify to be a sponsor for your husband should you decide to live in UK permanently?

Did you have a cover letter explaining your future plans?

His 18-year old daughter may not be a very good proof of his return but her birth certificate won't do any harm.

Not trying to be smart, did you consider getting married in Egypt?

Yes, tried getting married in Egypt, went through all the steps to find out I needed my divorce stamped in the Egyptian Embassy in London, didn't like the Ministry of Justice, didn't feel like the marriage would mean anything, no ceremony just awful. So I want to get married here.

As I said, he can't prove his income because he buys and sells for his business in cash, (not unusual in Egypt) if he suddenly started putting money into a bank account the HO would think this suspicious.

Explained our plans for the future in a covering letter but don't think we appreciated just how hard it is to prove our intentions. Seems it's just luck if they believe us. I don't quite earn enough for settlement here, but, we don't want to settle here. Not every foreigner wants to live in this country and I certainly don't want to stay here in future.
