Financial requirement - when can i reapply?

Hi all, I am new here :)

I applied for UK spouse visa twice and it was rejected both time. My lawyer did not guide me properly and was a waste of time.

My first application was rejected due to wrong English test. Everything else was fine. My lawyer advised me that the appeal will take longer so it's better to do a fresh application.

My second application was rejected due to financial requirement. I had a part time job since October 2018 and my lawyer applied under Category A, baring in mind I received cash for the month of May, June, July but I did not deposit it into my bank account.

i will not be using my part time job anymore. My full time job employment increased my hours from 37.50 to 38.25 effective from 01/11/19 ( however I will get a back payment in December as my salary this month had the old salary). I get paid £9.38 an hour and on my payslip it simply says Monthly salary £1528.44 ( before tax)

Can someone tell me when I can reapply, I have been with my full time employment since March2018.

For the next application, I will be relying on my full time job, where I earn £9.38 an hour. They have increased my hours from 37.50 to 38.25 hours per week from 01/11/19.

Can you help me shed some light, I have earned
£1528.44 before tax ( basic salary per month)- July 2019
£1528.44 before tax ( basic salary per month)- August 2019
£1528.44 before tax ( basic salary per month)- September 2019
£1739.49 before tax ( I worked 22.5 hours overtime ) - October 2019
£1528.44 before tax ( basic salary per month) - November 2019

new salary
£1559.01 before tax ( basic salary per month) - December 2019 ( i will also get back payment salary from Nov19).
£1559.01 before tax ( basic salary per month) - Jan 2020
£1559.01 before tax ( basic salary per month) - Feb 2020

Your previous wages wasn't sufficient and also wasn't deposited in full, therefore, it wont meet the criteria. However if you now have started getting the wages through bank transfer/cheque/despositing in full then might be eligible under category A in June 2020.

Hi seagul,

Isn’t there any chance I can apply before june2020?
As I would of earned an average of £9400 within last 6 months by jan/feb2020?

Any possibility of category A based on my full time job only.

My employment letter says “ we confirm xxx has been employed as xxxx since xxmarch2018. His working hours are 38.25 hours per week. The position is permanent and wages are based on an hourly rate of £9.38 which equates to approximately £18,707.05 (before reductions).

Wages are paid by direct debit to the bank every month..... etc.

Based on the letter, would you say since I had variable incomes in October19 and will have an increase in salary in December 19 onwards. Would You say I can apply earlier?

They wont believe it variable income under category A because almost all wages figures are similar and they will pick the lowest wages figure during the last 6 months which in your case is £1528.44 (most recently in November). If you have 6 months old cash savings in excess of £16000 then may use it to cover that shortfall if you are not willing to wait.
