Please advice: What if Overtime allowances paid separately

Post by xen400 » Mon Jul 28, 2008 2:26 pm

Hello Everyone :D

I hope someone with loads of HSMP wisdom in this forum can shed some light on my question.

My Overtime pay needs to be claimed on-line with my other claims (for which I submit receipts), so they don't show up on my payslips. Hence only a part of the deposit in the bank is actually for my overtime.

To give me some peace of mind my finance manager is willing to provide me with the letter stating that part of it constitutes part of my salary.

My question is: Will the Visa officer accept this as part of my previous earnings when it's paid on a separate random date and is untaxed.

What can I do? Any advice is much appreciated.

SAM :)

The following statement in the Tier 1 policy guidance should leave you with no doubts:
Tier 1 policy guidance ver. 06/08 wrote:109. We will only accept allowances as earnings if they are declared in the applicant’s payslips and there is a contractual obligation on the employer’s part to make these payments.
Suggest you read the guidance notes *carefully* and understand the rules.

Hi Sushdmehta,

Thanks!

I know, I have re-read that exact phrase many times :(

I only hope there is some way around this!

Along with my bank statements what if I submit a letter from my employer detailing all my earnings instead of submitting any payslips?
my finance manager is realy co-operative in this aspect :)

Thanks again.

Precisely the reason why I suggested that your *read the guidance and understand the rules* - becuase payslips aren't the only evidence from employer's end.

Should work if, for any given month (in the 12 month income period) in which you claimed overtime, your overtime payout (which is not in payslips) and salary payout (as reflected in payslips) were credited into your bank account in a single transaction for that month. I say so because if these two payouts (overtime and payslip salary) are credited into the bank in two different transactions, then the CW might question as to why salary is being credited in two parts (highly unusual) and this will raise a red flag!

Thanks a lot Sushdmehta,

The thing is that I am short of teeny amount to get the requisite 75 points, I think I'll ask my finance manager whether he can have my overtime pay put in with the monthly pay next time around.

Best of luck for everyone applying!

Sam
