Spouse visa: Living with mother on housing benefit

I am currently living with my mother in a privately rented home and plan to live here with my wife who will be on a spouse visa. Although I earn more than £18600, as she is on the higher rate of disability allowance my income is not taken into account when calculating her housing benefit allowance.

We will be living rent free and there is plenty of space in the house. The council are aware that I live here and of my salary. In the event my mother stops receiving housing benefit, my salary is enough to cover the rent comfortably.

I am aware that my wife and I should not have recourse to public funds. It is my mother who receives the benefits and I am down as a non dependent on the benefits letter. Therefore, is it okay for me to plan to live in this house with my wife as part of the spouse visa application, despite my mother receiving housing benefit? Will this count as having recourse to public funds?

Not for you. You will need the noc letter from council under current accommodation plans.

My wife's spouse visa extension (FLR M) was submitted online on 8/12/19. If she attends the UKVCAS appointment near the end of January, do we need to provide documentation like payslips that come after the date of application?
