I'm looking for some advice on the spouse visa application.
Here's the sequence of events:
- My partner and I lived together between December 2018 and April 2019 when she was visiting the UK.
- In April, my partner returned to the US to avoid overstaying.
- My partner and I were granted a fiance visa in late September 2019.
- My partner arrived back in the UK on 7 October and we began living together again.
- We got married on 26 November 2019.
- We are now applying for spouse visa and have collected all required evidence
- All our co-addressed correspondence represent the period my partner arrived on the fiance visa (from 7 October 2019), and not the period when she was visiting the UK for six months (i.e. no formal visa)
On the spouse visa application, I'm keen to understand whether we should be clear that my partner and I started living together in December 2018 or if we reference the date she arrived on the fiance visa, which is 7 October. Because she was visiting the UK, rather than on a formal visa, we do not plan to present formal postal evidence for the period we first lived together. I wasn't able to get any from a number of sources because she was visiting the UK, rather than formally residing. The council and utility company therefore defined her home as the US, rather than the UK.
The specific questions this is relevant to on the application are:
- When did you start living at this address (i.e. our shared UK address)? [note: under 'personal information' section]
- Time lived in the UK?
- When did you enter the UK? [note: under 'immigration history' section]
- When did you start living together in a relationship? [note: under 'other' section]
There is a section where it asks whether we've been living continuously together for 2 years. There are also other areas where we can make clear the timings of our living situation. The timeframe for cohabitation is also clearly set out in our respective letters.
Any advice on the questions above is massively appreciated. I'm sure lots of couples are in a similar position.
