ILR/ Spouse Visa

Good morning,

Been living in the Uk for 5years now on a spouse visa. Blessed with 3 kids. Me and my Mrs decided to separate last month. I am due to renew my visa in February (ILR). Am of the impression she will not support my application. Recently asked whether she has informed the home office of our separation but she is reluctant to confirm or deny it. i am confused. Should i inform the home office of this development? what are my options going forward. Any advise would be appreciated.

What are your kids’ situations and status? Who will they live with? Consider marriage counselling?

My kids are all British. One is 9 going 10, 4 and 2.. They live with their mum.. I Get to see them every week.. She says she hasn't informed HO of the separation but I can't trust her word..

If I go the parent route, does that mean am eligible to naturallize immediately after that?!

No. You have to get ILR first.

If you switch to the parent route, you will likely start a new 5 or 10 year period before you can apply for ILR. If you reach 10 years legal stay combining all visas, you can also apply for ILR based on long residence.

If you are divorced at the time you get ILR, you will have to wait 12 months on ILR before you can apply for citizenship.

ILR is mandatory before you can apply for citizenship.
