advice on Payslip

Post by coolthomas » Wed Dec 18, 2019 7:23 pm

I'm working with an agency on an hourly rate basis and receive weekly payslips. I'm hoping to apply for Spouse visa for my partner in March and will include the payslips for 5 months prior to me applying however over Christmas week, they don't issue any payslips and only begins the week after, so I will be missing one week's payslip.
Is there any way to resolve this like a letter from my agency or giving an extra week's payslip
Any advice
Thanks in adance

Payslips for 5 months, you mean 6?

You need to supply 6 months payslips/26weeks payslips since you are paid weekly.
If you work during he Christmas week and get paid same amount then it is to use the accumulated payslips for the period and explain this in your cover letter.

Sorry, I meant 6 months. So my weekly hours change according to the extra shifts I manage to get, therefore my weekly wage changes per week, however instead of getting paid for last week's shifts next week, they paid it this week and during the christmas week, they won't issue any payslip.
So for the shifts, I work this week and the Christmas week, I'll be paid the following week ( 30th December). So I was wondering if a letter from my employer stating this should be sufficient and if I clearly state in my covering letter.
WIll I need to compensate by providing an extra week's payslip to make the "26weeks payslip/6 months)
Thanks in advance

Definitely worth doing this to make it clear.

Not likely required. You are providing all payslips for a period of six months (26 weeks), not necessarily a specific number of payslips.

Spouse visa advice

Post by coolthomas » Mon Mar 02, 2020 6:56 pm

Hi I'm currently working with an agency and have been employed since Aug 2019, I recently got married and I'm hoping to apply to bring my partner over soon, hoping to submit the online application at the end of April. However my contract with this agency ends in the first week of august. Is it advisable for me to go ahead and apply in April, or wait until my next job before applying.I'm working as a doctor and will be changing jobs iN August.
I don't want a rejection in application just because my contract ends a few months after I apply.

Thanks in advance for your help

I waso n holiday for three weeks in February and therefore I had no payslip for 2 out of those weeks as I was paid for outstanding shifts during my holidays. I need to provide 6 months statement i.e 26 weeks statement as I'm working in an agency and paid at an hourly rate. My agency wont provide a zero payslip for the week I was on holiday, therefore, how can I get around the lack of 26 payslips?
Do I just ask my employer to include it in their letter?

Despite you should be at least employed and have earned sufficiently on the date of application but still if during the process if caseworker will contact your employer then may refuse/delay your application on not finding you there. Why not use priority service to get faster results.

If these were paid holidays then still the payslips get generated.

Thanks for your prompt response.

I was going to apply for the non priority service as my husband is doing his PG in India currently and won't finish until the end of July, therefore I can't apply for the priority service as the NON-pririoty usually takes 2-3 months and he will finish his studies by then and that is also the reason why I'm applying in April as I'm estimating 2-3 months for the visa application, but then realised my contract ends in the first week of August.
I'm not sure how to proceed with this as I know it is a risk. I have definitely earned well over the sufficient financial requirement at the time of application, I don't know whether to go ahead with applying around the 25th of April and hope for the best, or whether to post-pone the application. As from August onwards, I will be in another job, and will, therefore, need to provide 12 months statement etc, if I wait until after August.

in regards to my payslip, as I'm working with an agency, they apparently pay the holiday pay along with our weekly wages, therefore a payslip was not generated during Xmas when the office was closed and during my holiday. I was hoping that stating it in my employer and cover letter would be sufficient.

You need payslips to cover the specified period rather than a specified number of payslips, so it would seem your plan should be sufficient.

Up to you whether you believe it's a risk worth taking. I believe there is the option of applying now/soon and specifying a future travel date for the visa to be valid from.

Your employer can definitely be able to regenerate the payslip covering your holiday pay which will be taxed as usual. In my view if you don't want to wait then add a covering letter and request UKVI that you will start a new job in August and they kindly contact your existing employer before that if they wishes to do so.

This is the response I got when I requested a payslip for when I was on holiday
"
Apologies this is something that we are not able to do the system will not allow us to input zero hours"
What other options do I have in regards to the payslip?

ALso in regards to informing UKVI of the job change, wouldn't that be a hindrance to the application, as I won't actually know my new job location etc, until June-July and I presumed to inform them that I will have a job change but not having any information to provide to then in regards to the new job at the time of application ( April) will be detrimental to the application.
Also, do the UKVI really mind if I apply at say 25th of april and my job contract is until the first week of august, will they look into it as long as I meet the financial requirement.

I'm working as a locum/ agency worker, and someone said that UKVI doesn't consider that as a stable job. any advice on all of the above.
Thanks n advance.

Holidays are usually calculated on the basis of number of days/hours which their system can allow to input.

Apply with the believe that it would be processed before you join new job. Maybe your own plans change.

You are repeating same question which won't speed up the reply. UKVI caseworker is chained up with his own policy who excercise zero discretion especially where some core document missing such as payslip. As advised earlier that even someone goes on paid holidays but still he/she is being taxed same like the normal wage is being paid, therefore, the payslip must be generated even the paid holidays are lesser than the taxable income. I am not sure whether the employer letter will work.

All this is unnecessary.

You've already been advised that what is required are payslips that covers the period rather than a specific number of payslips.

For non-salaried, if you've been in continuous employment, it doesn't matter that you weren't paid for a certain number of weeks in as far as what you've earned in the period meets the requirement.

Payslip query

Post by coolthomas » Sat Oct 10, 2020 12:31 am

I'm hoping to apply for spouse visa next year.
I started a new job in July, however they had to pay me July as a one off BACS payment due to some issue with generating a payslip, and therefore I didn't get a payslip.
In my August payslip they have calculated my August pay and included my July pay under Retro pay and therefore calculated the gross amount for both July and August together (5500£) and deducted what they paid in July along with tax.

My query was , as this payslip essentially has 2 months of gross pay included ( July and august) can I still submit this one as my first of 6 payslips,( Aug-Jan) or is it best for me to wait until september payslip.
I will be earning well over the financial requirement.

Thanks in advance

Supplying 6 months of payslips are mandatory because of being boiled down to what has been strongly emphasised in the official guidance. Therefore, better to apply in February/January with the payslips of August - January.

I intend to provide 6 months payslip, but I was wondering if there is going to be an issue as in the August payslip, they have included my gross amount for July and August and deducted the BACS payment they made to me in July along with the tax.
Gross in Aug + July ( 5500 ), deducted from this amount is what I should have been taxed in August and July along with the one off BACS payment they made in July.
I have a payslip in August, but all this deductions have been made from my gross pay, which is essentially what I should have earned as gross pay for month of July and August, if this makes sense.

That unusual aggrandizement over your wages will certainly be noted although will have no affect because it is bit customary for every business to make similar adjustments whenever mistakenly have under/over paid to their workers/contractors.

So submitting August payslip should be alright right? I don't really want to postpone applying for spousa visa any longer as already I had to postpone it by one month as they paid me a BACS payment in Juy.
I can ask my employer if they will provide me a letter explaining the same. Not sure if they will do so but definitely will be asking them for a letter.
