Hey all
I’m looking for some advice.

I applied for a spouse visa via a solicitor who made quite a few errors which resulted in a refusal.

I’m a director of a company and pay myself salary and dividends.

I had shown all of the information to the solicitor and he had said it was all ok.

The refusal was because there was quite a few documents missing, also there was an error that solicitor made of implying that I’m an employee rather than a director.

However now that I have looked into it, after calculating the 12 month income that I paid during my accounting period on the ct600 I will be less than £9 short of meeting he £18600 threshold.

Has anyone been in a similar situation of of being this close to the threshold, if I appeal what’s the chances of them accepting it?

It's a minimum requirement that must be met.

I know of someone got refused by being short of pennies.

Can you show some savings to counteract the £9 requirement for over 5 years? Says like £45 that you have saved carefully over 6 months?

Can someone confirm if saving can be replied upon to meet the shortfall?

Why 5 years? :? However, only savings over £16,000 to make up any shortfall in earnings will be considered. The first £16,000 of savings will be disregarded.

Can't combine cash savings with income under Categories F and G (self-employment or director/employee of a specified limited company). Of course, this is only assuming the OP is a director of a specified limited company, sounds like they own it. Table on page 18 of the guidance document:
