Child CoE - Father naturalised British citizen + Mother Indian citizen with UK ILR

Post by Sukujobo » Wed Dec 25, 2019 9:29 am

Dear Mods/Members,

I am planning to join my husband in the UK with our soon-to-be-one daughter, I travelled to India for her delivery and have been away from the UK for 1.5 years. My question is what documents do I need for my daughter to travel to the UK now?

Some additional information:

1. My husband is a British passport holder and acquired his British citizenship through naturalisation when our daughter was almost 2 months old.

2. I'm an Indian passport holder and have a valid ILR (Indefinite Leave to Remain in the UK).

Can someone kindly guide me if you know what the process is or have gone through similar situation?

Thank you.

You need to apply for a child settlement visa. She needs an Indian passport first.

Your daughter cannot apply for CoE because she is not a British citizen.

You must return to the UK within 2 years absence.

Unfortunately, if your daughter was born outside the UK then she is not British. She may apply for a child settlement visa.
