Tier2 work from home

Post by Bilalhassan148 » Fri Dec 27, 2019 9:33 pm

Hi,

I have got my Tier2 General visa last month. My employer is open to allow me work from home but I am not too sure whether it's gonna breach any law or is it sponsors responsibility.

If its my company's responsibility then what steps they should take to comply with the rules.

Do they only need to update my work address on SMS? OR inform home office manually?

Please advise me accordingly.

Is it one day a week or work from home everyday?
My advice is based on personal research/experience, so pls check relevant UKVI sources.

If your regular place of work has changed then they need to add the information to SMS as change of cirmumstances.
I am not a lawyer and do not claim to be one. All my comments here are based on my opinions, experience and interpretation of the appropriate UKVI guidance documents and immigration rules.

Either way, it is not your problem or responsibility. Your employer will take care of this. If they don't know what to do, they can get compliance advice from the Home Office.

I would say 5 days a week but I can visit office on request

As long as there is no problem to my employer or me on Tier2 status

I understand this is not my problem but at the same time I don't want to be in trouble because of my decision to work from home because if their licence affects my visa affects as well

My employer is looking into this if I can work from home but I'm also concerned whether I should consider it or not as my office is very far from my home - it's about three hours drive

I used to work from home 5 days a week before Tier2 visa but now bit worried because I'm still working from home

Your advise would be really appreciated

Wait to find out what your employer finds out from the Home Office. Your employer is just as invested in doing it correctly as you are, maybe even moreso.

It would be interesting to know the outcome/response from home office.

If employer says work from home on a daily basis then it's almost like having an overseas/remote employee; however, in this day and age work from home is part and parcel of modern working practices.

Btw, just checked my CoS and there are two sections...

Main work address in the United Kingdom (mandatory for assignment):

Other regular work addresses in the United Kingdom:

Does your CoS mention your home address under any of these sections?
My advice is based on personal research/experience, so pls check relevant UKVI sources.

Thanks for the response

I have just checked my cos - I can see only main addresses which is my office address and other address field is empty

So does that mean I can work from the main address or my employer can add other address as well on the cos/sms which would be my home address?
