UK Citizenship

Dear All,

Need your kind input here. Me and my wife both have ILR in UK however my child was born in India 2 months ago. Please let me know if my child is eligible for British passport although born in India or should I only get Indian passport and then apply for ILR dependant? I havent taken Indian passport yet.

Your child is not British and has no entitlment to register as British either as the child was born abroad. The child would only have been British automatically if child was born in the UK to parents holding ILR.

Yes, this is the only option you have.

You must apply for his indefinite leave to enter (ILE)

For ILE the below applies as per Gov.uk website.

ILE carries the same entitlement as ‘Indefinite Leave to Remain’ (ILR) which is issued by the UK Border Agency to those who have already travelled to the UK. Anyone who has ILE does not have to apply for ILR when in the UK.

My son was born 2 months ago and he never travelled to UK. Do I still need to apply for ILE.

Yes, how else will he return to the UK if you don't apply for a child settlement visa, which means ILE should be granted.
