realy cvonfused about ILR

Post by charliegal » Thu Jul 31, 2008 8:44 am

Hi All, I am really confused ... For ILR it says on the website not to apply until 28 days before your qualifying period ends. it then says that the decision time takes between 4 and 14 weeks. Well if their decisio n takes longer than the 4 weeks then what happens as the visa will be run out?
Hope someone can help, thank u x

My understanding is that if you apply in time, your current visa is deemed not to expire while your application is being considered.

Can someone provide an "official" link?

Do a search on Section 3(c) of the Immigration Act.

Your legal status in the UK remains as per your current visa while your application is being considered, irrespective of how long this takes.
