I have searched the forum to see if someone else is in my position to no avail.
In short, my wife (USC) and I (UKC) have been married just over two years and currently reside in the UK. We are married in the UK on a spousal visa and have we lived here since, and my wife is currently on her 2.5 year FLR visa which expires in April 2020. Recently we have decided that a move to the US to be better suited to us, now that we have a child and my wife has a large family support in the US.
Here's the tricky bit. I am currently half way through the US visa process which unfortunately looks as though its going to take a lot longer than anticipated to complete. Possibly until the end of 2020.
We obviously do not want to invest the large amount of money in the FLR > ILR process before April for my wife, based on the fact we would have left the UK by the end of this year with no intention to live here in the future.
Once my wife's BRP card expires in April, am I right in saying that she would have to return to the US with our child if this is not renewed?
Is there a process where we can pay a fee to extend her BRP expiry date but not have to invest in the "next step" fully?
I hope this makes sense and if anyone who has been here before, grateful for any information you may have.
