Switch from Tier 5 to Tier 4

Hi,

My husband is under tier 5 visa and as dependents me (wife) and my 3 kids joined him. Our tier 5 visa due date is in May 2020.

While living in the UK, I have started my PHD last year and last November (2019) I switched to Tier 4 visa as by myself from Tier 5 dependent (PBS). To apply Tier 4 visa I went to Srilanka and went through the Tier 4 student visa application process.

Currently my husband is under tier 5 and kids are under initial tier 5 (PBS) dependent category but I am having Tier 4 visa.

Now I am planing to switch my husband and kids as my dependents. I am having below quarries regarding the application;
  • Is it possible to switch my kids from tier 5 (PBS) dependent to Tier 4 dependent from UK?
  • Do kids need to go back to Srilanka and apply as Tier 4 dependents from Tier 5 dependents?
  • Can my husband apply for Tier 4 dependent from UK or is it required to go back to SriLanka and switch the visa?

This is the same question 3 times!

Anyone with any type of current leave can make a PBS Dependant application in the UK, except those types of leave listed in paragraph 319C(h) [partners] and 319H(h) [children] of the immigration rules:

* visitor
* short-term student or short term student (child)
* parent of a Tier 4 (child) student
* temporary admission;
* temporary release
* immigration bail in circumstances in which temporary admission or temporary release would previously have been granted
