PBS Dependant to ILR

Post by Sinan87 » Sun Jan 12, 2020 9:32 pm

Hello
I need your advise please,

I am on PBS tier 2 general visa, I came to the UK in June 2015 and will be eligible for ILR in June 2020.

I got a question regarding my wife who is on PBS dependant Visa,

She Was issued her first entry clearance (as a PBS dependant sticker visa on her passport )from Amman/Jordan for the period from 14/9/15 to 14/10/15, she entered the UK on 2/10/15 and collected her BRP from the UK which was dated from 16/9/15 to to 30/6/17,
we then extended our stay and her current PBS dependant visa will expire on 16/8/2020.

Her overall stay out side the UK is less than two months.

My question is from which point can we start calculating her 5 years stay? Is it from the date of first entry clearance issuance on 14/9/15 ? Or her first entry to the UK on 2/10/15 ?

-If its from 14/9/15 would she be able to apply her ILR on 16/8/2020 (last day of her current Visa) to be considered as what I think 29 days before completing the 5 years as August is 31 days ?

Or does she need to extend her Visa as a PBS of Settled person then apply for ILR ?or to apply then do Variation ?

What would be your recommendation in this scenario ? Your advice is highly appreciated,

Many thanks

Thank you so much for your prompt reply,

Please can you help me calculating this as I am so confused,
Is it 28 or 29 days from 16/8/20 to 14/9/20 ?

Within 28 days before. Not 29 days.

Sorry, So According to this calculator the duration from 16/8/20 (last day of her current visa) to 14/9/20 is 29 days,
Or do you mean that we start calculating from the day after submitting the application (17/8/20) ?
