ILR for child born in the UK

Post by schwikk » Tue Jan 14, 2020 9:57 pm

Hi Everyone

I hope someone has been through this before and could clarify for me.

My wife and I are applying for ILR in July (we are on Ancestry visas) and wanted to know whether our son born in the UK (31/03/17) who is also currently on an ancestral dependant visa needs to apply for ILR with the us at the time of Visa expiry (31/07/20)? And if so, would the full application fee applicable to the child?

Thanks for any info

No he does not if you have plans to register him as British once either parent gets ILR. To register him as British costs £1023 and he does not need ilr or a valid visa if UK born as he has an entitlement to register as British. He also won't lose his south African citizenship as a child like adults do. He will remain a dual citizen for life.

If you choose to apply for his ilr, he pays the full fee. There is no discount for children or families applying together.

Thank you for the quick reply.

We will definately be registering him as british once we have our ILR. In this case he would not have to apply for ILR at all?

Sorry, just making sure I understand fully.

No. UK born children do not need ILR to be registered
