Please help anyone!! adequate maintenance spouse visa

Post by laurenjadekoylu » Mon Dec 02, 2019 2:18 pm

hello, I was wondering if anybody could help me, I’m so confused.

my husband is applying for the spouse visa soon and me being the sponsor will go the adequate maintenance route,as i receive carers allowance and I look after my disabled mum.

i have read you need £800 pounds a month after council tax and rent if 1 couple with a child apply.

will this class as my British daughter living with me who is not the daughter of my husband applying?

also I’m not currently working and I’m claiming universal credit, will this effect the visa, and will I need to be earning part time for it to be successful?

thank you so much to anybody who can help me

Per the guidance document linked below, which has several helpful examples, in order to meet the financial requirement using the adequate maintenance route your net income (A) minus your housing costs (B) must equal or exceed what an equivalent British family would receive in Income Support (C).

A - B > C

Where did you read that you need £800 left council tax and rent if 1 couple with a child? That's NOT true.

In order to meet the adequate maintenance for a family.
You need £114.85 per couple
66.90 per child
17.45 family premium

After all deductions of your income and accommodation, you must have 199.20 left.

Here is a link below which explains everything and it is very straightforward.

Income support is a weekly amount, so works out to about £800/month it would seem.

Just saying as a rough approximation, it's not as out there as you made it seem despite being an incorrect figure.

LOL!! Honestly OP mentioned £800 and I specifically mentioned that it isn't true.

"Income support is a weekly amount, so works out to about £800/month it would seem." I asked you to show me how you worked out that it would be about £800 yet you cant work out except guessing. I know youre always try to help and members are grateful for that but please if you don't know about adequate maintenance or haven't you used this route then please DO not comment on it.

Weekly income support of £199.20 is £863.20 a month (weekly*52/12). So, yeah, after housing costs about £800 a month would be needed. Just trying to make clear the importance of weekly vs. monthly amounts when trying to figure out the requirement.

For the purpose of calculating adequate maintenance. The guidance wants everything to be converted to weekly and NOT monthly so it is better we avoid the confusion and I have already worked out what the OP need after all deductions to make it easier for her to understand it.

You certainly can. The amount of cash savings is converted to an available weekly income as discussed in Section 3.3 from page 9 of the guidance document previously provided (including several example calculations). Only the amount held by you and/or your partner for at least 6 months can be used. This specified evidence for cash savings is:

"(a) Personal bank statements showing that at least the level of cash savings relied upon in the application has been held in an account(s) in the names of the person and their partner jointly throughout the period of 6 months prior to the date of application. and
(b) A declaration by the account holder(s) of the source(s) of the cash savings."
