Australian marriage immigration

My partner is currently on a youth mobility visa which expires in May and she will be returning back to Australia. I will be accompanying her on a tourist visa (I am 37) for 3 months. At this point we will have been in a relationship for 1 year and are looking at options to stay together. If we were to marry in Australia while I am on the tourist visa - would it be fairly straight forward for her to apply for a spouse visa and return with me to the UK? Does anyone have any advice or experience they can share?

I would never use the word "straightforward" for that. It's not. The Home Office could well turn around and ask you to go to Australia and live there with your wife.

One of the major things is: do you work in the UK? How much do you earn? Do you have savings?

To the best of my knowledge, your T5 YMV partner cannot sponsor you as a dependent/spouse. You must qualify for your own visa.

Thanks for your help so far. I work full time in the UK and earn £42k and own my own home. We would not be entitled to any public funds obviously which is fine. We were hoping that my “wife” would be able to apply for a visa based on being my spouse. On the basis that my job and home is in the UK, we really need to settle here - at least to begin with. We were wondering if it was better to apply for a fiance visa so she can return with me in August and then we marry within the 6 months, or, do we just get married in Aus and apply for a visa to bring her back as my married partner? We have not been cohabiting for minimum 2 years so an unmarried partner visa is not possible. If we married in Ausrailia and we applied for her to come back as my wife, does anyone know what hoops there are to jump through ?

1. Get papers required: finance/work, accommodation, proof of relationship
2. Application fees
3. Waiting. Depending on the time available to you in Australia, it is highly possible that you will travel to UK alone to keep working (and you need it to be able to prove the financial requirement). These applications take time (seems like a couple of months at least)
4. Mental strength to go on with your life while waiting

WhatsApp messages, photos (incl future wedding photos), bookings for holidays together, your tickets to Australia. If you were already living together as she is in UK currently, then bills into both of your names/or each one of you separately, tenancy agreement (if available).

Ow, well.. wedding certificate, of course, once you get it. But the certificate itself isn’t enough. This applies only if you apply for spouse visa, naturally
