FLR (M) Extension

Afternoon,

I would appreciate some advice / guidance on the below situation.

My wife is approaching her first extension towards the end of the year for her FLR M visa. We are fully aware we cannot apply longer than 28 days prior the expiry date or 30 months residence, as this will cause a shortfall of the 5 years required for the ILR visa.
The situation my wife in, is that her BRP does not 30 months it falls just short. Details as below:

Date of issue - 15/05/2018
Valid until - 24/10/2020.

If we work to the 30 months residence from issue date (15/11/2020), earliest we can submit is 18/10/2020 which will be leaving it tight to the expiry date of 24/10/2020. But if we work to 28 days prior expiry date (26/09/2020), my wife would not have 30 months and could be an issue achieving 60 months for the ILR visa.

We are in the understanding we should submit our application online between the 18/10/2020 - 24/10/2020 to achieve the 30 months.

Would appreciate if anyone in agreement with the above or maybe better guidance / advice getting around it.

Was the original visa application within the UK or from abroad?

You should probably have raised this brp issue at the time and had it corrected.

Thanks for the prompt response.

The original visa application was raised in the UK.

Assuming be too late to contact Home Office?
Best to get everything prepared and save so on the 18/10/2020 we submit online?

What service are you using, standard 8 week or 24 hour super priority??

Not also that you only need to submit and pay online before the visa expiry date. The biometric appointment can be a date after the visa expiry.

Datw of new visa will the date it is approved.

Had you received the decision letter before receiving the BRP card? If yes then maybe you could have been granted earlier than the date shows on BRP card. Many members had experienced to receive their BRP cards after several weeks.

Again thanks for the reply.
We are planning to do premium service again for this extension. But reading up it maybe best to do standard as it might give us couple more days window for when we apply for the ILR. This that correct?

There is no premium service with ho caseworkers anymore.

You apply online and you biometric appointment is with ukcvas sopra steria, a third party agency. You also scan and upload all your supporting documents to the ukcvas portal after you submit and pay online and before the biometric appointment. Super priority 24 hour service costs an extra £800 on top of the £1033 visa fee and £1000 IHS and there is no guarantee you will get a decision within 24 hours.

Ahh this now makes sense!! My wife got her letter of approval on 24/04/2018 and her BRP was sent out 3 weeks later. Which means her BRP expiry date of 24/10/2020 is correct.

Good to know my wife can work 28 days back from 24/10/2020 for early submission, although she'll submitted 2 week prior expiry.

Thanks for informing us with the above, good to know.
My wife now got the joys of filling out an online application instead of the paper application. Hopefully not too different.
