ILR - Tier 2 general PBS Dependents still not completed 5 years in UK

Post by Cvijay » Wed Jan 29, 2020 2:18 pm

Hi Experts,

This July I will be applying for ILR, but my family is yet to complete 5 years in the UK and their visa expires in Sep 2020.

My wife and Elder son (4years) came to the UK in 2016 March and have the tier 2 general PBS dependent visa valid until Sep 2020. They had a year break during 2017-18 and they were in India for my second childbirth. They came back again in 2018 June and that means that their new clock has started in June 2018.

My question/confusion here is if I get ILR and will they be given an extension on their current visa for 3 more years or will they be allowed to apply for ILR dependent Visa? Please confirm.

Thanks,
Vijay

1. There is NO absence limit or 'clock reset' for PBS dependents whose visas were issued BEFORE 11th January 2018.

2. Apply for a tier 2 dependent extension once you have ILR. It will be a 3 year extension and you must meet the 90 days maintenance funds of £630 for each dependent.
