Spouse Visa Extension - 30 or 33 months to reapply?

Hello,

I am coming to the end of my first Spouse visa and need to apply for extension within the UK — but I can't work out when to do so. The BRP is actually for 33 months, even though when I applied the documentation said it was 30 months (my residence permit card expires after 33 months).

The gov website says the earliest I can apply is 28 days before the visa expires, but I can't understand if that's the 30 months ( which is September 2020 in my case) or the 33 months ( which is November, 2020? I don't want to apply too early or too late..
Could you please reconfirm when do I need to apply? There are three dates:
— date approval was given (20 Feb 2018)
— date entered UK ( 02 March 2018) – Do I need to apply for extension in August, 2020 then, or -
— date of expiry of BRP (19 November 2020) – DO I need to apply in October,2020 -?

You can apply no sooner than within 28 days before reaching 30 months residence from the date you entered the UK and at the latest, apply before your visa expiry date.

30 months is 2nd September.

Thank you very much for your help in advance. i'm about to apply for my 2nd Spouse Settlement visa. Country of origin is Azerbaijan, Baku. for the last 2 years lived here, in the UK with my husband. Have a big questions for anyone who can help :

• What is the best time to apply for a second spouse visa, as the expire date on BRP is 19th November, 2020 ( i.e. 33 month), I arrived on 2nd March, 2018 ( 30th Month expires in September 2020). Should I apply 28 days before 2nd September or should I apply 28 days before 19th November?
• DO I need to pass TB Test again , as I ‘ve done it when applied 1st time for the Spouse visa and after obtained my Spouse visa i live permanently here, in the UK.
• Do I need to get Non-Criminal Convictions letter again from Azerbaijan as I ‘ve done it when applied 1st time for the Spouse visa.
• My husband is a sole contributor for utilities and any expenses coming from our joint account is his money. He pays for all the utilities, and the house, all the bills are on his name ( he bought the house before our marriage), and this was agreed between us, that he will be the only provider for the house and money I earn will be used for my own purposes ( as my salary is not very big, and as im still working on the fixed-time contract). What type of cohabitation documents we can provide then? And how can we answer the question what we pay for together?

This has already been answered. The advice doesn't change.

Any letters addressed to each or both of you at the same address for the last two years.

Note that you also need English A2 test for an extension. The A1 test for the first visa isn't enough.

Sorry, i cannot find the answer with regard "Non-Criminal Convictions" Document. DO i need to ask the Police here to issue one? Or do i need to request this from Baku, as this was a requirement for the first visa.

For the attention of advisers, who comments the posts with regards the 1st Spouse visa extension period. Below is the official reply from the UKVI Center. It only counts toward the date , which is Printed on the back side of BRPs ( even it counts as 33 months!) People should apply 28 day before the expiry date of BRP, and if you apply before this date, the application will be invalid. I also contacted them today by phone and the information provide was the same - people have to apply 28 days before expiry date

Thank you for your enquiry dated 27th January regarding a Visa extension.

You would need to apply to extend your visa 28 days before the expiry. The expiry date will be stated on your current document.

And the second letter received ( dont really know why it was 2 replies :
Thank you for your enquiry dated 27th January about a visa extension.

You can apply at any time but we recommend you do not apply until 28 days before your leave expires. Your residence permit will have information about when your leave expires.

Yes, correct. Same answer as mine. They do not recommend to apply before 28 days Stated On BRP, as this will affect on your 5 year route time frame. But you should not apply exactly on your 30th month, if your BRP was issued for 33 month. They recommend to submit the documents based on the expiry date stated on the back side of issued BRP.

There are numerous threads about it where members got success after applying 30 months. Unless your personal circumstances or visa rules including application fee not changing then extension should be applied very close to expiry to avail the maximum length of visa.
