Fiancé Visa general question

Post by Laure95 » Wed Feb 05, 2020 10:03 am

Hello, I would really appreciate it if anyone can help me with this.

I am lebanese and my partner is Irish. We are in the process of applying for a Uk fiancé visa. The only problem is, we are not sure if my Irish partner can sponsor me under this scheme. He doesn’t have any restrictions on his stay in the UK being Irish. He, however, does not have any document explicitly saying he has settled status in the UK (it is not required of him). He’s been working and living in the UK for the past 2 years. Are we then eligible for applying for a UK fiancé visa in this case?

Any help is appreciated.

While Irish citizens are not subject to immigration control themselves, I'm not sure whether this entitles them to sponsor spouse visas as British citizens or persons settled in the UK can, hopefully someone else can help with this.

However, you could likely save a significant amount of money by applying through the EU settlement scheme after you are married (details at the website below) rather than the UK spouse visa route. Unfortunately I don't believe there are provisions for bringing a fiance to the UK under this scheme.

I'm just a guy on the Internet who immigrated to the UK. My opinions are based on my experience and interpretation of the immigration rules and should not be considered legal or immigration advice; your mileage may vary.

Thank you so much for your reply. For personal reasons we want to go down the UK Fiancé Visa route rather than the EU settlement scheme. And you’ve hit the nail on the head as we are also unsure whether my fiancé is entitled to sponsor me under UK regulations or not. I’ve read somewhere that he has settled status on arrival but again we are unsure.

I hope someone can shed some light on this.
