Urgent!! Admin review: duration of leave granted

Post by chilledchill » Thu Feb 13, 2020 3:12 am

Hello all , I am also on a similar situation. Need help.

Type of visa : Tier 2 General - shortage occupation list.
COS approved and ISC paid for 3 years.

But the HO has given the visa only for 2 years on the BRP though I have paid the IHS charges for 3 years.
I am not sure what to do here because I applied outside the UK.

still i filed for administrative review but got the below response .. this is strange

-------------------------------------------------
Administrative Review

Your administrative review application has been rejected.
Thank you for your application of 29 January 2020 for an administrative review of the decision on your application for leave to enter the United Kingdom as a Tier 2 General applicant We are unable to accept this application because it is invalid and therefore it will not be considered.
Reasons why the application has been rejected
An administrative review application must meet the requirements of paragraphs 34L to 34Y of the Immigration Rules in order to be valid. We have rejected the application for the following reason:
Paragraph 34P states that the application for administrative review must be made in relation to an eligible decision. The decision that you have applied to have reviewed is not eligible for administrative review as we cannot review errors in grants. If you believe the issued BRP expiry date is incorrect please report this using the following link:

For all other enquiries, please follow the guidelines at the following link, which gives details of our enquiry centre contacts: www.gov.uk/contact-ukvi-outside-uk

Write back to the Home Office for reconsideration.

Hello Rooney ,
Thanks to you for your response.
I did get a further notification today morning as below :
----------------
Thank you for your e-mail, I can confirm that you are entitled to leave until the 02/12/2022. I have contacted the BRP team and requested that a card is issued as soon as possible. The team will be in contact with you shortly.

-----------------------------------
so looks like my case is heard by some other department within HO. not sure if the other case officer ,who rejected my admin review, internally redirected my case to the respective department.

Also , point to note - the overall grant is 35 months (1 month less than the 3 year term requested) . but that is ok since now I have thrown this problem to the past. I am happy about the outcome.

Now my main question is, will my current BRP be valid ? The mail from HO / Entry clearance Errors team did not mention anything or refer me to any URL about it.

I have lots of travel planned starting 20th Feb - in and out of UK multiple times till march 5th .
what precautions I need to take in such case.

Any light to this scenario will be of great help. Meanwhile , I am going to reply to the same mail asking HO to clarify on this error correction process .

Until you get your new BRP card, you can use the old one without any issues as the Immigration officer will know about your leave validity.
