Spouse Visa Extension 2019 - HELP

Hi guys,

So my husbands spouse visa is due to expire in November 2020, and we will apply for the extension.

I earn above the income threshold of £18600, however I’m currently pregnant and due to sickness and being unwell I was only paid £800 for the month of February. This means that I will not meet the income threshold.

Also, I am due to go on maternity leave in May 2020 and because I haven’t been working at the workplace for long enough to get SMP, I will apply for maternity allowance, which will only give me around £500 a month, again not meeting the income requirements

I know that I can combine my income with my husbands to meet the requirements but my husband doesn’t earn a lot to be able to bring our monthly income to £1550. He is trying to find a job and we’re hoping he does by the time I go on my maternity leave, but we have failed to meet the requirements for February anyways due to my low wage.

I’ll be giving birth in June 2020, so we will have a child under 18, British citizen. We have both given up on the fact that we will be able to meet the financial requirements which sucks.

Does this mean that we will now need to apply for the 10 year route??
Also, if we just need to submit 6 months worth of payslips then there may be some hope?

Yes, you can.

I know that I can combine my income with my husbands to meet the requirements but my husband doesn’t earn a lot to be able to bring our monthly income to £1550.

Are you in salaried or non-salaried employment? A minimum monthly income of £1500 is not the only way to meet the financial requirement. Before giving up on this completely, I would suggest a careful read of the guidance document linked below to see how it relates to your circumstances, particularly with regards to unpaid sick/maternity leave and applying under Category B.

If by the time you will go on maternity leave if the combined income of both of you would be at least £18600 from the last 12 months and your salaried income will remain same then you still might be able to fulfill the financial requirement. Alternatively, the easier way if your partner finds a new job or starts earning sufficiently at his present employer so that by November 2020 he has 6 months of payslips.

Ahh thanks for this!! This means my unpaid sick leave in February will not be counted, that makes me feel a lot better! We will be getting a solicitor so I’ll go through everything with them before submitting our papers, I just wanted to do my own research beforehand.

I’m in salaried employment, and so is my husband. We don’t have another other source of income or savings we can use to fulfil the requirements.

My husband works as a freelance graphic designer, so instead of showing wage slips as proof, what other evidence can he show? He gives invoices to his client so would this count?

No because payslips are mandatory. Is he paying his own taxes means self employed?
