Need help regarding financial requirement evidence

Post by Im_jyo » Thu Mar 19, 2020 4:57 pm

Hello all,
I am applying for a UK fiance visa to join my fiance who is a British Citizen.
1) After trying hard for nearly two months we were able to get a letter from his employer confirming his employment. But I am confused about whether it has all the information required. Can anyone please confirm it for my peace of mind!

2) He has working hours per week as you can see in that letter and he gets paid holidays per year, but his wages differ each month as he works for more hours and is paid at an hourly rate. He believes he is a salaried employee and says that is how people in the support care industry are being paid. But I think they would consider him as non-salaried as his wages differ per month; In this scenario which option should, I select among these to be on a safer side?
  • The same amount continuously, above the financial requirement amount
The same amount continuously, below the financial requirement amount
Not the same amount continuously, above the financial requirement amount
Not the same amount continuously, below the financial requirement amount
The salary for the last 12 months is like this:
Month Gross Pay
Feb-20 1453
Jan-20 1845
Dec-19 2232
Nov-19 2157
Oct-19 1184 (Sick leave and trip to visit me)
Sep-19 2283
Aug-19 1794
Jul-19 1621
Jun-19 1655
May-19 1604
Apr-19 952 (Sick leave)
Mar-19 573 (Sick leave)

His salary slips come like this

Thank you in advance for your guidance

1. Employer letter seems slightly incomplete due to having no mention about pay rate, accumulation of the last 12 months wages and overtime work.

2. If he has 37.5 contractual hours then it means he is a salaried person while also a none-salaried person where he is earning extra through overtime.

3. Under category B he seems to have been earning sufficiently to meet the financial requirement.

1. Would adding the contract letter help? Their HR dept is pretty lazy, I have no hope of them correcting the letter for us.
3. Are you sure we would qualify under Category B as his latest payout went below 1550 (as its Feb)?!

Thank you for your response!

1. Maybe if contract letter is within 28 days

2. If you wont calculate overtime through none-salaried approach and then wont add back to your salaried income then you will fail.

I am totally confused about whether he is salaried or non-salaried. They do state normal working hours and then they state pay per hour with no mention of an annualised or anything like fixed salary anywhere. Even the 'basic' payment shown in the payslips varies depending on the hours he work!

Sorry for asking this before confirming whether he is salaried or non-salaried. If he is to be considered as salaried, as per my understanding his last payslip is the evidence; which would make him go below the financial requirement as he never received a pay rise and 37.5 weekly hours x £8.5 per hour x 4 weeks = £1,275 !

Unfortunately, It's just missing a few days! They gave him a new contract letter on 5th Feb '20 due to change in company management.

The salary slip never shows a breakup of overtime payment and normal hours. It just says 'Basic' and mentions how many hours (day time) he has worked in that month. There are many months in which these basic hours are more than his contractual weekly hours x 4, and it is counted as 8.5/hour so I have started doubting whether he is non-salaried! What are your thoughts? I am adding the relevant sections of contract below

Same as advised earlier that he is a salaried person with annual salaried income of (37.5 hrs*8.50*52= £16575) while also a none-salaried person due to undertaking extra work as overtime. You need to isolate the overtime income from the total wages which will be calculated through none-salaried approach where the average annualized income is calculated.
