Tier 2 pay cut below COS salary due to COVID-19 outbreak

Post by e241196 » Sat Mar 21, 2020 4:23 pm

My company is a Tier 2 sponsor and has several Tier 2 employees (SOC 2136).

Due to COVID-19 financial impacts on the business they have asked all the employees to take a temporary pay cut.(company-wide pay cut)

If current pay is £52k, the new pay is going to be £37k, and the salary mentioned on the Certificate Of Sponsorship is £45k:

1- Will this breach immigration rules?
2- Should the employer inform HO and wait for the confirmation before applying this change?
3- Some of us will be eligible for ILR later this year (between August and December), will this affect ILR applications?
4- Are the immigration rules the same for Tier 2 RLMT and Shortage Occupation regarding this matter?

I would appreciate if you could help us with the the above questions.

Many thanks.

Thank you for the link. It is very useful to track the updates from HO.
However, it doesn't answer the questions in my post.

My questions are regarding to the current immigration rules about reducing salary of Tier 2 employees.

These are questions for the employer who is sponsoring your Tier 2 visa. If they don't know, they need to find out from the Home Office on behalf of their sponsored employees.
I do not give immigration advice. I refer you to Immigration Rules, guidance, other online content and to your sponsor.
