About UC : UK citizen-wife on spouse visa (non EU)

Post by q4questions » Thu Mar 26, 2020 4:10 pm

Hi, My 2 kids and I are UK citizens. Wife got visa extension under 5 years spouse visa rule. She is not entitled for any benefit. I take £34.40/week child benefit for 2 kids. My self employment income is 15k/year and she earns 6k/year.

Question 1 : Will my wife be granted visa, If my kids and I take Universal Credit and as a couple if we fulfil the income requirement (which is 18600) ?

Question 2 : Due to corona virus, my self employment work is affected. I am seriously thinking to apply for universal credit. But in the form, if i add my wife's name as a partner, they will calculate income for a family (of a couple and 2 kids). And it will affect her ILR application as she is not entitled for any benefit.
If I don't add her name then I have to show myself as a single parent and it's a lie. What is the solution ?

I found similar questions in many threads but not very clear answers. :|
Keenly waiting for the solution.
Thanks in advance.

You must claim as a couple but you will only receive the single plus children element.

Note that if at the time of visa extension and ILR, if you do not meet the financial requirements, her applications will fail and she will likely be put on the FLR(FP) 10 year partner route, which means she will have to wait 10 year on FLR(FP) before she can apply for ILR.

It is unclear from your post how long she has been in the UK and what stage of her spouse visa she is on, presumably her second 2.5 year visa.

Do you have a partner?
(This can be a boyfriend, girlfriend, husband, wife or civil partner.)
  • Yes, and we live together
  • Yes, but we do not live together
  • No, I'm single

The reason I said it is confusing (for me) was, there are 3 options and I don't know which option I need to select ? For your reference, I have attached 3 images with 3 options and their next pages respectively.
Please suggest me which option I should select to avoid any future problem for my wife's ILR.

Her extension was granted in mid 2019 and she will apply for ILR in the end of 2021.

It's the first option obviously.

If my partner starts a joint claim, then will that affect on her ILR application ?

When I continue for the first option, it asks me creat my wife's application to merge both application into one by sharing a code. But she can not register for UC as she is not entitled to public fund. And if i can not share code within certain days then my application will be considered as a single person.
if I declare that I am not living with partner then it does not fulful the requirement of visa.

It does not seem very simple to me.
