Schengen Visa for Husband whos UK visa expires in Nov 08

Schengen Visa for Husband whos UK visa expires in Nov 08

Hello..

My husband (South African) is currently on a 2 year marriage visa and this expires on 20th Nov 08, when we will apply for ILR...However we would like to go to Spain for a cheap week holiday in Sept. He will have less than 3 months left on his UK visa can he still get a Schengen visa??

I am aware that as the spouse of a British Citizen he is entitled to go to Europe with me and no visa...but i haven't risked this yet and even last week in Dublin he was asked to join the Non EU line even though we travelled together from the UK!

Answers gratefully received... he is having sun withdrawal symptoms!!

Actually he does need a visa to travel to the Schengen states even though he is married to you, a British National. Technically he shouldn't need one once he has ILR, but this is risky, and many Stupid (especially the budget ones) will be very likely to refuse him travel.
As your spouse he doesn't have to pay for a Schengen visa, but unfortunately he will need 3 months left on his visa to be issued with one.
I don't know where you are thinking of going on your holiday, but Spain is one of the worst for 'sticking to the rules'.

Maybe easier to get a French Schengen and travel through France to Spain. I got a cancellation appointment last week and we go on Thursday - hope they give us a multi-entry so that we can use it for Greece later in the year...I've heard too that Spain like bank statements, proof of employments etc. etc. :roll: French Consulate web link follows>>>

Yes, Spain do ask for bank statements and proof of employment.

Thanks for your help...

He has had no problem getting a schengen visa previously from the French Embassy and just takes my passport along, pretty easy. I just wasn't sure whether the Nov expiry on his current 2yr marriage visa is a problem (less than 3 months) but it appears it might be...so cheap sunny Cornwall for us until after November!

We're just about to cancel an appointment we have for 2.p.m. tomorrow, 14/08 for a Schengen from the French consulate in London. Might be worth looking at their website to see if it becomes available if anyone is looking...

Hi,

I've got a similar problem - I have a British passport but my husband has a 2 year spouse visa (Bangladeshi passport) which will expire in Feb 2009. I think he can apply for indefinite leave in Jan/February. We wanted to visit Europe in December. Is it possible for him to apply for a Schenzen visa now? And how is the best way to apply? We want to go on one of those coach tours which will go to Switzerland first then Italy and Austria.

I've been searching all over the net and it's amazing how confusing all the information is! If anyone can help, I'd be really greatful.
