Confused - advice needed please

Post by Poppylily » Fri Apr 17, 2020 8:38 am

Hi all,

New here and looking for some information which I can't seem to find with the help of Google.

Story.. so I met my now husband 5 years ago, he is Nigerian but came here over 12 years ago, on a leave to remain Visa due to siblings (half - mothers side) being born here.

His last application over 2 years ago was the same as it ever had been really.

This time however, since we are married and it is all done online, it is asking for alot of information on myself? Such as 12 months bank statements, payslips and proof of citizenship.

He is not applying as a spouse as he has always been here of his own accord, so is all this right?

If someone can please advise whether it is correct they require all my information too, I would be very grateful and I am really confused as to the process.

Thank you.

Which category of visa does he currently hold? 12 years on a limited leave to remain visa seems excessive.
If he has held a valid visa for 10 years, why hasn't he qualified for ILR under long residence? :?

Thanks for replying.

I just asked and he said he doesn't know which category visa it is.

He also said he went down the leave to remain route since 2011, he believes this is the last application for limited leave to remain, and the next time he can apply for indefinite.

It's just a minefield for me, I don't understand any of it.

Unless you are able to post his full immigration history, it will be impossible for anyone to advise you. Your partner says that his last application was in 2011. However, a limited leave visa doesn't remain valid for 9+ years without renewing (generally for 2.5 years).

At the very least, ask to see his passport with the visa vignette, or his Biometric Residence Permit (BRP).
