Tier 4 to Spouse

Hey guys just a quick question;

I am Tier 4 student and my visa expires by the end of july 2020. My partner is British and we have given notice of marriage at registrar office. They told us to wait for home office response before getting registered because my status is Tier 4.

So when I got the letter from Home office it said they are not going to investigate but 28 days cap must remain. Now due to Covid Marriage registrations are closed until further notice.

I am just worried about the time line here if we don't get our marriage registered than I probably have to go back before my visa expires and this is what I want to avoid. My partner works full time and fulfills all requirements to support me.

Is there any suggestions to extend the visa in special circumstances? Or should I engage Home Office regarding the same.

Well, you may have to return back if visa is not extended

If they reopen offices in June and I get an early and apply before mid June 2020? Do you think 30-40 days are enough for them to process the application? I will probably go for premium service.
Should I not tell them beforehand hand that I was gonna apply for Visa however due to Covid I can't? Will they give any extension in this regard?

I am yet to submit my masters dissertation by the end of May and I will probably apply for extenuating circumstances to extend it. Also new admissions will resume in Sept.2020 :(

That's a sigh of relief. Thank you for this update. Another quick question? As our degree awarding ceremony will probably be held in Oct. 2020 (what I heard my course director said). What are the chances to extend on these basis? Probably get another 3 months? Is that something that's possible.

Hello guys,

Thank you in advance for all your efforts to understand this process. I have another query if you could please let me know;

1) We will register for marriage as soon as Lockdown eases as we already given the notice back in March. My partner has 5 months payslip
and for the month of July, payslip can be obtained before my Visa expires on 27th Of july 2020. Would this be acceptable?

2) we have tons of pictures and people verifying our relationship as genuine. She pays taxes and earns enough money to support me. Also do I need to take english language test such as A2 or B2? As I am already about to finish my Master from London because that does not make any sense I have IELTS I have studied and completed my degree in english.

3) Also should I Involve a lawyer anyways?

4) I can confirm that I have all the checklists completed apart from Marriage registration and 5 months payslips.

Please guide if there will be problems?

1. You need 6 months payslips and 6 months bank statements at the date if online application submission.

2. Photos and friends statements are irrelevant and won't be considered. You need to submit evidence of meeting the English requirment, either a UK degree certificate if minimum A1 IELTS English life skills.

3. Your choice but not needed.

Note that you might not have enough time left on your visa to marry within the UK. You have to give 28 days notice at an ho approved registry office. They notify ho and this 28 day period can be extended to 70 days before ho will give permission for you to marry.

Hi, Thank your for your reply. For the last part, we have already give notice of Marriage and the registrar office did notify Home Office about it and took our details. And then we both received a letter from the HOME OFFICE saying that they will not investigate our case and we can go ahead with the registration of marriage. I really things go well however I want to thank you for all for your kind responses.

My partner is insisting that I should take at least A1 english language test. To me, it does not make any sense, because I did IELTS when I was applying for UK, and I am doing MSc (Masters from London) and my degree is nearly at the end.

Is the above not enough for HO to accept application? Or do I need the degree to show to them?

To use a degree, you need to have the actual degree certificate. If you don't have the certificate, you need A1 English Life Skills test.

Seagul, Thank you for you quick response. It does not have any UKVI number however it was conducted by British Council in Karachi, Pakistan. I can test report form number on it. Test actually took place back in April 2018 and It says it expires in 2 years so technically it is expired. This is so frustrating :cry: .. Should I rather apply for UK NARIC certifcate now?

The other thing is I would not have my degree until that time I believe not sure how long does it take to award the degree. I will probably have to ask Uni. Administration. And also due to COVID our deadline for dissertation was extended to 12th June.

Unquestionably it will really be an excruciating exercise in redoing the ielts test despite you are studying a master degree. But if you have an honours/4 years of bachelor degree then may consider the naric comparability route. Both routes will cost you almost same but the date of test might not easily be catchable anytime soon.
