Switch to unmarried partner visa from tier 5 (YMS)

Post by daisy2020 » Tue Apr 21, 2020 9:15 pm

My current Tier 5 (YMS) visa will be expired on Nov 2020, before that, I want to apply unmarried partner visa as my boy friend is a full British citizen. I just want to know if I can switch to partner visa or no? I know many website say it's able to switch, but I couldn't find the guidance in Gov.uk official website, so I am not sure. Someone can help me to find out with evidence or guidance from Gov, which could convince them when I apply? Thank you so much!

Paragraph 284 in Part 6 of the immigration rules explains the requirements, and sub-paras (i) and (iv) are specifically about what type of current leave (visa) an applicant must have:

(i) the applicant has or was last granted limited leave to enter or remain in the United Kingdom which meets the following requirements:
(a) The leave was given in accordance with any of the provisions of these Rules; and
(b) The leave was granted for a period of 6 months or more, unless it was granted as a fiancé(e) or proposed civil partner; and
(c) The leave was not as the spouse, civil partner, unmarried or same-sex partner of a Relevant Points-Based System Migrant or Appendix W Worker;

(iv) the applicant must not be in the UK in breach of immigration laws (except that, where paragraph 39E of these Rules applies, any current period of overstaying will be disregarded);
I do not give immigration advice. I refer you to Immigration Rules, guidance, other online content and to your sponsor.

Post by daisy2020 » Sat Apr 25, 2020 10:13 pm

I am renting the house which is 2 bedrooms for my partner and I. But we rented from my friend, we didn't sign tenancy agreement, I transfer rental into my friend's account every month. Then, how can we proof we meet the accommodation requirement. Thanks

If your friend owns the property then his no objection letter allowing you & your family to live there along with his/her mortgage statement will be needed. However, if your friend is also a private tenant there then if he/she has subletted you without the landlord's permission then it won't work.
The opinion expressed as above is neither a professional advice nor contesting/competing to other member's opinion/advice.

What evidence are you submitting that you have lived together in a relationship akin to marriage covert the mandatory two years?

This is evidence to show joint financial and other committments for a minimum of 2 years etc to prove you are not simply just a boyfriend/girlfriend.

Maybe you weren't exposed to the Home Office too much. With them, rule number 1: anything you cannot demonstrate, doesn't exist.

You are talking about an accommodation, but without tenancy/letter agreement or a similar letter from the landlord, this property might as well exist only in your imagination as far as the Home Office is concerned.

Same for boyfriend/girlfriend status. It will get you an automatic refusal. You need to demonstrate (by documents) that you are more than a boyfriend/girlfriend. This could be living at the same address (utility bills/council tax... to both names), having a joint account where your finance go... etc. and that's for 2 years+ Only then, they will look at you in an "akin to marriage" relationship.
