Spouse visa.. I'm really confused.

Hi All,

I am really confused sbout what to do so please only advise if you're sure;

My wife got her first visa in December 2013, she arrived in February 2014.. we then applied for FLR(m) 2016, it got declined as my earning was £100 lower than £18,600 so we appealed the decision as this was due to me having a car accident and I had to take time off work, at the appeal I showed that in the time since the original decision I have earned more than minimum threshold. My wife was granted her visa in December 2017 for a further 2.5 years. So my wife has been in the country for 6 years 3 months now.

Forward to now, I have been self employed for a year, we now have a child and my wife is on maternity leave, I am due to submit my account to my accountant and my net income is below the £18,600 threshold due to the impact of COVID-19.

Do I apply for her indefinite leave to remain in these circumstances or shall I use some other route?

Was she granted the extension under 5 years or 10 years of route????

She was given extension under 5 year.
But due to time waiting for her appeal, went silent note than a year waiting so it accumulated more months so she been here 6 years 3 months

If she has earned sufficiently before commencing her maternity leave then that income can also be used towards meeting the financial requirement.

She was on a zero hour contract so not much there, do you think I should go down 10 year route do to having a child

Haven't you have cash savings? If not then probably going for 10 years of route may only be the option left.
