ILR Self and Dependent

Post by ankitzee » Sun May 10, 2020 8:35 pm

Hi

I am currently on Tier 2 General Visa and applying for ILR application for myself as my current Tier 2 Visa expires on 15 Sept 2020.
I have two questions regarding ILR application for my wife who is on a Dependent Visa:
1) Her first dependent visa has a start date of 24 Sept 2015. She was on Tier 4 Student Visa prior to that for one year. My understanding is that we can apply for her ILR 28 days prior to that date (i.e. 28 Aug 2020). Can someone please confirm this or do we need to first get an extension of her dependent visa before applying for an ILR?
2) I am applying for an ILR for myself now, do i have also change her visa from Tier 2 dependent to ILR dependent?

Thanks in advance
Ankit

1. Yes, she can apply within 28 days before her initial dependent visa start date.

2. No!
