Post by Andkelso » Wed May 20, 2020 5:17 pm

Hi all/ Zumba,
I am sending via mobile ,pls excise for typo errors!
Pls keep this separate if overlapping with others as per urr ules.

My friend Jo applying for Flr(FP) as a dependent of British Child( qualified child) within UK.
1)Both British child+ British mom are in same address along with Jo, cohabitation for more than 2 years!
2)Currently ,Jo acting as parent to the British child[ BC],
It just so happened that British child biological father is separated from child when child was born& child Mom is happy taking Jo to act as parent to the child.
3)Thus British child& British Mom gave a self witness statement to Jo,so Jo can apply for Flr FP,& continue help the child in daily activities as a responsible parent.
British Mom is also sponcering as her salary is 25K GBP meeting the min requirement salary threshold in Appendix FM ,by providing payslips& other tax forms supporting application for Jo.
4) By the time of application submitted, the Divorce process b/w British mom& child biological father was not complete ,but still in process, could be pending till further 3 or years,
5) Jo submitting all the relavent docs (passport+English language+LITUK test)+ 2+ years cohabitation docs with the child& mom as a family, other 6 different sets of same address proofs+ insurmountable obstacles statement for Jo if sent back to India.
Claiming human tights article 8 ,acting as parent to British child in FLR(FP)
Q1) can this application be considered by ukvi or it's straightforward refusal???
What r the chances?
Q2) will adding divorce certificate from biological father to mom would be added advantage ,if submitted during g the waiting period of application processing time?
Q3)is the court order certificate stating that jo has the rights of parent given from family court : mandatory for Jo to summit along with application?
Q4)Are there any other list if Docs they may help this application for better chances??

Plszz provider inputs ,a timely reply is deeply appreciated!!
All experts pls help others too in this big forum ,helping many families union back!
Note: Be safe at all times: corona. Will power for good matters a lot!

Do NOT tag your questions onto other members topics!!

Also, LIUK test is NOT required for an FLR(FP) application.

I don't think so that your friend JO will be entitled for FLRFP only based on an colloquial arrangement as being the acting father of British child. However, instead he might qualify for unmarried partner visa if he has been legally living and be able to demonstrate that he has developed the relationships with British sponsor akin to marriage from the last 2 years. For this purpose language, financial and all other essential requirements will have to be met.
The opinion expressed as above is neither a professional advice nor contesting/competing to other member's opinion/advice.

Hi, great thanks!
As I am using mobile & little new to group, if that is do ,requesting to plszz move my thread to separate one,I tried my side & it's not working,I changed the title too, still it's reflecting in same thread.
I oblige ur rules, but due to mobile app,it's not going! Pls help guide me instead of blocking my thread! Deep thanks for understanding!!!
To summarise(w.r.t parent -child subsisting relashion ) ,it's OK if at least a Genuine parent child relashion been established for min 2 years b/w child and parental father& it need not be necessarily be only with biological father in this case!
