spouse visa extention queries

Post by OptiNe » Thu Jun 11, 2020 2:10 am

Hi, a friend of mine is urgently needing advice about a spouse visa extension, as they seem to be running out of time without realizing. I am not sure about the answers and I hope you would be able to help and thank you in advance.
Briefly, the applicant is on Spouse visa; entered the UK on December 2017 to collect biometric residence permit using initial 30 days visa, travelled abroad for 50 days then returned back to the UK on February. Additionally, the biometric residence permit expires on August 2020.
- When would the entry date to the UK be? December or February?
- How to calculate the visa extension due date, will it be by June 2020 (30 months from initial uk entry date)? Or by August 2020 (before the expiry of the biometric residence permit ?.
Financial requirement
The sponsor of the applicant is a British citizen (in full-time education). To meet the financial requirement (18,600) both the applicant and the sponsor are working and have the following income:
Sponsor
6- Salaried employment with an annual income of £12,000
7- Self-employed offering freelance online service 1 with an annual income of £2,000
8- Self-employed offering freelance service 2 with an annual income of £4,000
Total = £18,000
Applicant
9- Self-employed offering freelance online service 1 with an annual income of £600
10- Self-employed offering freelance service 2 with an annual income of £4,500
Total = £5,100
I would like to ask the following:
- Can the aforementioned income sources for the last year be combined?

- In the FLR application do they enter 4x self employments ( 2 for sponsor (service 1 and service 2) and 2 for the Applicant (service 1 and service 2). Or can they combine and enter 1 self employment for each (1 for sponsor and 1 for the applicant) and detail the services provided in the self-employment? As they receive one SA302 and self-employment tax return per person regardless of the number of services they provide.

- In regards to the self-employment tax return, does the tax have to be submitted in full before the application submission or would an SA302 be sufficient?

- To prove self-employment one of the evidence listed below should be provided, can you assist please with how to handle this section especially that they work as freelancers, offer online services and don’t have business locations and don’t require authority permissions:

• Annual audited accounts for the last financial year
• If not required to produce annual audited accounts, unaudited accounts for the last full financial year and an accountant's certificate of confirmation, from an accountant who is a member of a UK Recognised Supervisory Body (as defined in the Companies Act 2006) or is a member of the Institute of Financial Accountants (IFA)
• A certificate of VAT registration and the VAT return for the last full financial year (a copy or a print out) confirming the VAT registration number, if turnover is in excess of £79,000 or was in excess of the threshold which applied during the last full financial year
• Evidence to show appropriate planning permission or local planning authority consent is held to operate the type or class of business at the trading address (where this is a local authority requirement)

The evidence for living together
they have lived together within different addresses over the last 2 years and they are currently living together as well, in the same address, they don’t have bills as the tenancy contracts cover/ed all bills and council tax. Furthermore, one of these accommodations was an ensuite room in a shared property.
- Is an inspection report required of the shared property? Or would a letter from the agency or landlord be sufficient?
- Is evidence of rent payments needs to be provided (bank statement), what about when paying rent as cash in hand?
- Can you please help with knowing how many documents they have to provide (explanation detailed below) as it is confusing and whether the number of documents has to be provided for each separate address or through the 2 years in general?
Items of correspondence addressed to Doctor xxxxxxxxx and Ms xxxxxxx at the same address as evidence you have been living together since your last grant of leave in this category, or from the date you first started living together, covering the last 2 years. You must provide at least 6 items of correspondence, addressed to you and your partner jointly or in both your names. The dates of the items of correspondence should be spread evenly over the whole 2 years. They should be from at least 3 different sources. If you do not have enough items in your joint names, you may also provide items addressed to each of you individually if they show the same address for both of you. For example - 4 items of correspondence in joint names to the same address and 2 items addressed to each partner at the address. In total 8 items would need to be submitted. If you and your partner have no bills or correspondence in joint names, you will need to submit 12 items (6 each) of correspondence evidencing that you reside together at the same address.

Approved English language test

Unfortunately, the applicant has not done the test as all centres were closed due to COVID 19 pandemic but have registered to take next post submission date.
- Would this be accepted?
- What is the time window between the application submission date and appointment for sending the documents? And how the appointment is booked?

December entry is the start date.

Inspection report not required. Tenancy agreement and letter should be fine.
- Is evidence of rent payments needs to be provided (bank statement), what about when paying rent as cash in hand?
Not required.

They need evidence for the two years from how ever many addresses they have lived at, from 3 to 6 different sources, in either joint names or addressed individually at the same address, spread evenly for every 3 to 4 months.

P.s. please do not post full names of people on the forum!!
